Terms of Service

These Terms of Service ("Terms") govern your access to and use of the DBL Films website (the "Site") and the interactive cinema / edit-bay experience hosted at this domain (collectively, the "Service"). By accessing the Service you enter into a legally binding agreement with DBL Films (the "Studio", "we", "us"). If you do not agree to every provision of these Terms, you must discontinue use immediately.
1. Nature of the Service
The Service is a portfolio website operated by an independent boutique film and video production studio. It displays a curated catalogue of past works (music videos, brand films, documentary, street football archives) and provides an interactive interface ("the Edit Bay") for visitors to compose personal viewing playlists ("screenings") from that catalogue and share those playlists via URL.
- No Account Required: The Service is browsable without registration. There are no user accounts on the public site.
- No Purchases: The Service is informational. No goods or subscriptions are sold through the Site.
- No Guarantee of Availability: Embedded video playback depends on Vimeo, YouTube and other third-party platforms over which the Studio has no control. We do not guarantee that any specific clip remains available, embeddable, or playable in your region.
2. User Eligibility and Conduct
By using the Service you represent and warrant that:
- You are at least 16 years of age (or the age of digital consent in your jurisdiction, whichever is higher).
- You will not use the Service for any unlawful purpose or in any manner that could damage, disable, overburden, or impair the Service.
- You will not attempt to gain unauthorised access to any part of the Service, related systems, or networks.
- You will not use automated systems (bots, spiders, scrapers, headless browsers) to harvest content, generate fake share links at scale, or otherwise impose disproportionate load on the Service.
- You will not reverse-engineer, decompile, or attempt to derive source code or trade secrets from the Service.
- You will not circumvent, disable, or interfere with security features of the Service.
3. Intellectual Property
All films, footage, photography, music, voice-over, graphics, branding, designs, code, and original written content displayed on the Site are the intellectual property of DBL Films, its principal, or the respective third-party rights holders.
- Limited Viewing Licence: You are granted a personal, non-exclusive, non-transferable, revocable licence to view the catalogue through the Service for non-commercial purposes only.
- Prohibited: You may NOT download, screen-record, re-host, redistribute, re-edit, dub, remix, license, sell, sublicense, or commercially exploit any content from the catalogue without prior written permission from DBL Films.
- Archive Material: The street football and Masters of the Game archives include works in which the Studio holds rights as director / producer; certain footage may also be subject to third-party rights (athletes, locations, music). Licensing enquiries: info@dblfilms.com.
- Trademarks: "DBL Films", the DBL Films wordmark, and associated branding are unregistered trade marks of the Studio. Use without permission is prohibited.
4. The Edit Bay and Shareable Screenings
The Edit Bay allows you to sequence clips from the public catalogue into a screening, optionally trim in/out points, and generate a shareable URL representing that sequence.
- Viewing Playlist Only: A screening URL is a sequence of pointers to publicly-displayed catalogue items. It does NOT grant the recipient any download, redistribution, or re-edit rights to the underlying content.
- No Persistent Storage of Your Cuts: Screenings are encoded entirely in the URL itself; the Studio does not retain a database of your composed screenings.
- Hidden Clips: If a clip referenced in a screening URL has been removed from the catalogue or marked private after the URL was created, that clip will silently drop from playback. The Studio is under no obligation to maintain link integrity for screenings shared by visitors.
- Public by Default: Anyone with the URL can play the screening. Treat screening URLs as you would any public link — do not include them in private contexts where you would not share the underlying public clips.
5. Third-Party Embedded Content
Video playback is delivered via third-party iframe embeds from Vimeo and YouTube. By interacting with these embeds you accept the terms of those platforms:
- YouTube — Terms of Service and Google Privacy Policy.
- Vimeo — Terms of Service and Privacy Policy.
The Studio is not responsible for the content of third-party platforms, the cookies they set, the data they collect, or changes to their player APIs.
6. Photography and Gallery Content
Stills displayed in the Gallery section remain the copyright of the photographer (Darrell Bell, unless otherwise credited). The viewing licence in Section 3 applies. Image scraping, re-hosting, or AI-training use is expressly prohibited.
7. User Communications and Submissions
If you contact the Studio (for example, via email at info@dblfilms.com) you grant the Studio the right to read, store, and respond to your message. Unsolicited project pitches, treatment ideas, or creative submissions are accepted only on the basis that you waive any claim to compensation should the Studio independently develop similar work.
8. Service Modifications
We reserve the right to modify, suspend, or discontinue any aspect of the Service — including the catalogue contents, the Edit Bay, the Gallery, or the entire Site — at any time without prior notice. We are not liable to you or any third party for any such modification or discontinuance.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DBL FILMS DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DBL FILMS, ITS PRINCIPAL, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF DBL FILMS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE STUDIO'S TOTAL CUMULATIVE LIABILITY UNDER OR IN CONNECTION WITH THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED EUROS (€100) OR (B) THE AMOUNTS YOU HAVE PAID TO THE STUDIO IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM (which, for users of the public site, is zero).
11. Indemnification
You agree to defend, indemnify, and hold harmless DBL Films and its principal, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right (including intellectual property or privacy rights); or (d) any content you submit, post, or transmit through the Service.
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the competent courts of Amsterdam, the Netherlands. If you are a consumer in the EU, this clause does not deprive you of mandatory consumer protections of your country of residence.
13. Severability
If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent.
14. Entire Agreement and Updates
These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and DBL Films regarding the Service. We may revise these Terms from time to time. Material changes will be reflected on this page with a revised "Last updated" date. Continued use of the Service following a revision constitutes your acceptance of the revised Terms.
